PAGING SERVICE AGREEMENT
The small print stuff that nobody ever reads . .
SUBSCRIBER AGREES THAT:
1. Pager reception can be affected by terrain, distance from nearest transmitter, power lines, adverse atmospheric conditions, battery failure and other conditions. Beyond Beepers cannot, and does not guarantee 100% reception due to such conditions beyond its control.
2. Beyond Beepers will make every reasonable effort to provide services as specified. However, Beyond Beepers cannot and does not guarantee such services. Beyond Beepers shall not have any liability under this Agreement for any monetary damages resulting from claims made by Subscriber or any third party for errors, omissions, interruptions od delays in the services provided hereunder. In any event, Beyond Beepers' sole liability for money damages shall be limited to an amount not to exceed one month's monthly charges paid by Subscriber.
In no event will Beyond Beepers be responsible for special, indirect incidental or consequential damages which Subscriber may incur or experience on account of entering into or relying on this agreement, even if Beyond Beepers has been advised of the possibility of such damages. Beyond Beepers makes no warranty, express or implied, of merchantability or of fitness for a particular purpose. Repair or replacement shall be sole remedies to Subscriber.
3. In the event of service interruption, it is the Subscriber's responsibility to notify Beyond Beepers promptly Beyond Beepers is not responsible for service interruption due to Subscriber's actions or omissions (such as equipment misuse or abuse, or failure to make timely payments, etc.) and no credit for such down time will be issued. If service interruption id due to broadcast network failure, Beyond Beepers will issue a credit for down time greater that one full business day following notification of such occurrence by Subscriber, and written confirmation to Beyond Beepers by Subscriber.
4. Beyond Beepers cannot be responsible for loss, change or substitution of the telephone access number assigned to the Subscriber's pager by the Paging Carrier or the by the Telephone Company.
5. In the event that the Subscriber's bank check is returned to Beyond Beepers as uncollectible, Subscriber's paging service shall be suspended, and a abd check charge of $20.00 shall be assessed to Subscriber's account.
A. Standard rates are based on monthly or biannual billing.
B. All charges are payable in advanced. Subscriber may terminate any obligation to pay for further service by 30 days written notice in advance delivered to Beyond Beepers.
C. Invoices are billed as of the first day of security month (which is the last month of prepayment). Payment is due by the 15th day of billing month. Pager service may be terminated without further notice after the 15th of the month, if payment is past due.
D. Reactivation fee of $10.00 will be charged for terminated pagers. Beyond Beepers cannot guarantee return of same phone number access to Subscriber in case of service interruption.
E. No refunds will be issued for unused service.
